All the users of website www.Adgency.co (“Website”) undertake to observe the general terms and conditions of the use of Website (“General Terms”). By the use of Website, the unconditional acceptance of these General Terms is involved. If don’t agree these General Terms, please don’t access the Website anymore and don’t continue to use the Website.
“User” means any natural or legal entity accessing the Webiste.
The provisions of these General Terms are completed with other sale terms or/and conditions and special specifications related to the sale and procurement of products and services offered on the Website, as the case may be, in accordance with the User’s request.

Adgency.co owns the legal rights regarding graphics, form, exposure method, as well as the whole Website content, including, but without limitation to the images, music, information about products and services that may be procured by the Website and any other data and applications on the Website. These are protected by the legislation of copyrights, in force. Any infringement or attempt to infringe the copyrights on the Website, including, but without limitation to play-over, sharing, trading, renting, loan, communication, public address, copy, change, display, transmission, publishing, in any form, of the Website content and graphics, establishment of derived materials using the content and form of the Website, under the penalties provided by law.
Provided that a User inserts marks on the Website, the whole liability regarding the insertion of marks, names and/or logos on the Website (e.g. ownership of the property right, of a right of use etc.) exclusively belongs to the relevant User, Adgency.co being exempted of any liability in this respect. Adgency.co will be entirely entitled to remove immediately the insertion of the relevant marks, names and/or logos, as well as to take any other measures related to the publishing on the Website, without any right, by a User, of a mark, name or logo.
Adgency.co reserves the right to unilaterally change, any time and without any prior notice, the content, display form and/or the structure of Website, any information and/or terms and conditions on the Website, including these General Terms, the changes coming into effect on the date of their publishing on the Website or on a date expressly specified by Adgency.co in this respect, such changes being considered as accepted by the User, if he continues to use the Website after such a change.
Adgency.co may suspend or interrupt the operation of the Website, with immediate effect and without prior notice, as consequence of a trading decision of Adgency.co in this respect or for the purpose of updates, reparations, maintenance works or for the purpose of improvement of the Webiste performances.
The Users are not allowed to change or delete the symbols or other visual identity signs of “Adgency.co” mark.
Purpose of Website and limitation of liability
The Website proposes to offer the Users correct and updated information, but Adgency.co does not warrant the actuality, any time, of the information displayed on the Website and is not responsible, cannot be considered responsible to the correctness of data, information and content (hereinafter referred to as “information”) or User comments published on the Webiste.
The Users are directly responsible to any information or comment they publish on the Website. The Users undertake not to publish on the Webiste texts, data, sounds, files, software, videos, pictures or other types of content that:
- Come into variance with the Romanian enforcing laws, these General Terms, Internet ethics, good conduct and good custom rules;

- Includes personal data of a third party or information protected by law;

- Militate for or advise to violence over the persons, animals, humiliation, life threats and/or body integrity of the persons and/or animals;
- Include references or images regarding accidents or offences, both concerning the authors, and the victims;
- Have a pornographic or sexual content;
- Show or advise to sex, race, nationality, ethnics, citizenship, origin, religion or belief, education discriminations, faiths, marital status, social condition, political affiliations, handicap, age, sexual focus, family status, patrimony or others;
- Show or advise to conducts that threat the environment protection;
- Brings offences to the reputation, honor or dignity of other persons;
- Includes information regarding terrorism or that advise the commitment of terrorism actions;
- Infringes the rights of property or harm the interests of other persons;
- Surpass the maximum size allowed on the Website.
The Users are not permitted to publish, transmit or make any reference to messages which contain viruses or any other code sequences which prove to be destructive or which may interfere with, eliminate or limit the functionality of the Website.
Regarding the comments made by Users on the Website:
It is forbidden to post materials or messages which are abusive, vulgar, hateful or resentful towards other Website members, containing threats or violating the law, the intimacy or private life of someone else;

Adgency.co shall not be responsible to the content of messages or information published by the Users or to the information published by third parties and which are accessible by the Website; however, it reserves the right to erase the content of messages published on the Website which violate the provisions of these General Terms or which may seem to possibly hurt or cause any damage to Adgency.co, other Users or third parties, regardless of partially or totally erasing the content of the message, erase which will happen without any prior or subsequent notification of the User concerned and without any liability or compensation, of any nature, towards the concerned User.
Adgency.co will make all the due diligence to assure the use of Website under safety conditions, but Adgency.co does not warrant anyway the quality of Website from the technical and/or operational point of view or the lack of viruses that could be, at a given time, on the Website. Adgency.co should not be considered liable anyhow to any direct or indirect damages suffered or invoked by the Users, resulted by the content or malfunctions of the Website.

Adgency.co is not liable to the direct, indirect loss, including the loss of data, interruption or presence of errors in certain programs. Adgency.co is neither liable with respect to the information published on the Website, wether it is correct or wrong, or with respect to the information published on any other external website where the Website directs.
Adgency.co will not be liable anyway towards the Users, for indirect damages (e.g. un-achieved benefit, profit losses, loss of business opportunities etc.).
Adgency.co has the right to unilaterally decide the prohibition or suspension of access to the Website to any User, without a justification liability and without being liable anyhow towards the relevant User.

Additionally, Adgency.co has the right to remove or not allow the display of information or any kind of materials, possibly prejudicing anyhow a third party, infringe the legal provisions or be against the good customs or national safety.
Use of Website by natural entities
Adgency.co, by the Website, makes available to the Users, natural entities, the possibility to access for free the information published on the Website, under the following conditions:
- Without account – navigation and direct search on the Website
- By the establishment of an User account – navigation, search, customization and use of account functionalities as registered User on the pages of claimed business.
Provided that the User, natural entity, owns an account on the Website, he may register to the competitions or may add information according to the active fields on the Website.
A registered User may send suggestions for the change of information about the business listed on the Website, using the button “Edit” on the page of each business.
Use of the Website by leagal entity
Adgency.co, through the Website, provides legal entity Users with the option to publish free trade Information relating to their activities, Information that relates exclusively to: the legal name of the user, registered address and / or work point, website address owned by the User, contact telephone number, e-mail address for transmitting electronic messages, bussines line and information on the services provided, opening hours, payment methods available to Users.
In order to publish Information, the User, legal enity, must have an account on the Website with a username and a password. Adgency.co bears no liability whatsoever and has no obligation to check on the quality of the individuals that create such an account in the name of a corporate User.
Leagal entity Users who register on the Website may be required to provide a type of validation by telephone or by submitting any documents attesting to the quality of the company’s legal representative that he/she adds or claims on the Website.
In the eventuality of an objection to certain Information, upon the settlement of the respective complaint, the Information contested shall be withdrawn from the Adgency.co Website. In case a User makes redundant complaints, which are found to be groundless, in order to protect individuals in relation to that information published on the Website, Adgency.co can restrict access to the User in question on the Website.
Ordering procedure and service accessing
To access or receive information about Adgency.co service offer, Users must fill out contact forms dedicated or require an offer by phone at the number displayed.
By filling out the contact form (“Contact Form”), the User will agree that Adgency.co may transmit the order acceptance or other order processing-related messages to the e-mail specified by the User in the Contact Form. Along with completing the Contact Form, the User expressly confirms that accepts the Terms and Conditions and shall specify whether it agrees or disagrees with the processing of personal data for the purposes mentioned by Adgency.co, where appropriate.
After receipt by Adgency.co of the contact form, Adgency.co will transmit to the User the contract for the services requested by him within the Contact Form, at the email address of provided by the Userin the contact form. Only after execution / acceptance by the User of the contract received from Adgency.co, according to instructions received in this regard from Adgency.co and after the receipt by Adgency.co of the contract signature / acceptance, Adgency.co will provide such services contracted by the User.

According to Law no. 677/2001 on the protection of individuals with regard to the processing of personal data and the free movement of such data and the Law no. 506/2004 concerning the processing of personal data and privacy in electronic communications, updated, Adgency.co undertakes to manage safely the personal data provided by each User and only in order to achieve specified goals.
User data will be used by Adgency.co for the management of the Website, to inform Users on their account status, on the services and / or evaluation services, commercial activities, activities to promote products and services, to conduct advertising lotteries, to perform marketing, advertising, media, customer relation activities, market research, statistics for the prevention / detection of fraud, for the purposes mentioned in the Order Form and in any other purposes permitted by law.
Adgency.co undertakes to apply, in connection with personal data of its Users appropriate technical and organizational measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized disclosure or access, in particular where such processing involves the transmission of data in a network, and against all other unlawful forms of processing.
Personal data collected from Users by Adgency.co through the Website will not be disclosed to a third entity (outside Adgency.co group) to be used for direct marketing purposes, if the User has not explicitly expressed consent in this respect. Adgency.co may provide personal data of Users to other companies within the Adgency.co group, such as OTE or DT. Also, Adgeny.co may provide personal data of the Users to other Adgency.co partners, if this is related or required to fulfill services contracted through the Website or other activity for which the User has created a personal account on the Website.
In order to process personal data the partners of Adgency.co are empowered persons according to Law. 677/2001 and notified to the National Supervisory Authority for Personal Data Processing Carcater.
Personal data provided by the User on the Website may be disclosed to legal entities, public authorities and institutions empowered, at their request, in accordance with the legal provisions in force.
By completing the data required to create a personal account on the Website, the User has been informed and has accepted the General Terms and Conditions for Use of Adgency.co Website. The User agrees explicitly and unequivocally that their personal data submitted to create a personal account on the Website and the Website registration may be used by Adgency.co and its partners.
Also, Adgency.co can provide Users’ personal data to other companies that are in partnerships, but only under a confidentiality commitment on their part, which guarantees that the data are kept secure and that the provision of personal information is performed according to the law, as follows:
a) to some third party appointed / authorized by Adgency.co to provide for and / or on behalf of Adgency.co the services available on the Website;
c) to operators providing services of market research;
d) to the contractual partners of Adgency.co and to their auditors;
e) other persons, under the law.
On his personal data, the User has the following rights: information, access and intervention to, the justified opposition to the processing thereof, not to be subjected to an individual decision, to go to court, according to Art. 12 to 18 of Law no. 677/2001. The User has the right to object at any time, free of charge and without any justification, that his personal data to be processed for marketing. To exercise these rights, the User will submit to Adgency.co a written, dated, signed request, mailed to the Free Press Square no. 3-5, City Gate, North Tower, Bucharest, sector 1, code 013702 or by email at [email protected] The request shall specify wether the User wants the information to be communicated to a certain address (e-mail) or by a mail service delivery to ensure confidentiality. Adgency.co shall communicate the measures taken / information requested within 15 days of the receipt of the request.
Any attempt to access, use, modify another User’s personal data is strictly prohibited and is punishable under administrative or criminal law, by case.

Applicable Law. Litigations
The present General Terms are governed by Romanian law.
Any misunderstanding in regard to these General Terms will be resolved amicably. If such a resolution is not possible, the dispute will be referred to the competent courts of law in Bucharest.
